The short answer

Yes. Using a VPN is legal in India. No law forbids an ordinary person from using one, and companies across the country use them every day for remote work. What changed in 2022 was not the legality of using a VPN. It was the set of rules for companies that run VPN servers on Indian soil.

What the CERT-In rules changed

In 2022 CERT-In, the government's cyber security agency, issued directions that require VPN providers, data centres and cloud companies to collect and keep customer details for five years: names, addresses, contact details, the IP addresses given to each customer and the purpose of use. The directions apply to services operating in India. Several international VPN brands reacted by removing their physical servers from India. Akimbo has never had any here. What is illegal with or without a VPN

  • Piracy: downloading or streaming films and shows without a licence.
  • Betting and gambling on sites that Indian law prohibits.
  • Fraud, harassment, threats and hacking.
  • Sharing content that is unlawful under the IT Act.
  • A VPN does not change the law. It changes only what your operator can see.

Blocked apps and blocked content

India has blocked many apps and sites by government order, and people often ask about particular cases. For example, are pakistani dramas banned in India? In 2025 platforms were told to remove content of Pakistani origin, and many Pakistani YouTube channels were blocked for Indian viewers, so a pakistani drama banned in India on one platform may not be available through the usual routes. Is a particular brand legal?

People ask whether one product or another is allowed, for example is proton VPN legal in India. The law does not list brands. Using any VPN service is legal. The difference between providers is whether they follow the record keeping rules by logging customers on Indian servers, or avoid the question by keeping their servers abroad. Special cases

✓Jammu and Kashmir: local authorities have at times restricted VPN use in certain districts for limited periods. Check local news.
✓Offices and colleges may forbid VPNs on their own networks. That is a policy, not a law.
✓Government employees may be bound by separate IT rules at work.
